Privacy Policy

1. Introduction

This Privacy Policy explains how FITACABO Indústria e Comércio Ltda. ("FITACABO", "we") handles the personal data of visitors to www.fitacabo.com.br and people who contact our support channels, including WhatsApp through the ChatBot_FitaCabo application integrated with Meta's WhatsApp Business platform.

It describes the data received, its purposes, storage, sharing and the channels for exercising rights under Brazil's General Personal Data Protection Law (LGPD — Law No. 13,709/2018).

2. Data Collected

2.1. Website and commercial enquiries

Depending on the fields completed and the enquiry, we receive your name, phone or WhatsApp number, email, company, CPF or CNPJ tax identifier, product of interest, referral source and message. A CNPJ lookup may supplement the registration with publicly available company information.

2.2. WhatsApp support and ChatBot_FitaCabo

When you message our channel, we receive from the WhatsApp Business platform and store in our systems the data made available for that interaction, which may include:

  • Profile name, phone number or user identifier provided by the platform;
  • Message content and information you choose to share, such as contact, company, order or product details, or a location sent in the conversation;
  • Message and channel identifiers, dates, times and delivery or read information, when available;
  • Type, caption and references to images, audio, videos or documents sent, depending on the event received from the platform.

These records are stored to register and maintain continuity of support. This integration does not give FITACABO access to your other private conversations or your device's address book. Share only information needed for your enquiry.

2.3. Browsing

Website access may generate technical records needed for operation and security, such as IP address and access date and time. Depending on your choice in the cookie banner, Google Analytics may process cookie identifiers and browsing information to produce statistics. These identifiers are pseudonymous; we do not describe this processing as fully anonymous.

3. Purposes of Processing

We use data to register, organise and follow up on enquiries; provide commercial assistance and support; prepare requested quotes and proposals; retain the history needed for support; identify faults and protect systems; and comply with legal obligations or exercise rights. Browsing statistics, when authorised, help improve the website.

Contacting us on WhatsApp is not general authorisation for unrelated advertising. Promotional communications, when sent, must have an applicable legal basis and allow recipients to opt out.

4. Legal Bases

Depending on the purpose, processing may rely on a contract or preliminary steps you request; a legal or regulatory obligation; the establishment, exercise or defence of rights; or legitimate interests in support and security, respecting your rights and expectations. Where consent is required, such as for analytics cookies, it will be requested specifically and may be withdrawn.

5. Sharing and International Transfers

We do not sell or rent personal data. Access and sharing are limited to the stated purposes and may involve:

  • Authorised FITACABO teams responsible for your enquiry;
  • WhatsApp/Meta, whose platform enables communication and delivery of information to ChatBot_FitaCabo;
  • Infrastructure, hosting, security and communication providers, as necessary to operate the services;
  • Google, for analytics when you authorise the relevant cookies;
  • Authorities and other recipients where required by law or necessary to exercise rights.

Using global providers may involve processing data outside Brazil. Transfers for which FITACABO is responsible must follow the mechanisms and safeguards required by applicable law. Third-party services also have their own policies: WhatsApp Privacy Policy and Google Privacy Policy.

6. Cookies and Preferences

The website uses resources needed to operate and remember your choices. Google Analytics loads only after acceptance in the banner. You can refuse analytics cookies or change your choice using "Cookie preferences" in the footer. Your choice is valid for approximately six months; withdrawing consent removes analytics cookies controlled by the website and stops new measurement after the page reloads.

7. Storage and Retention

Registration data, messages and support records are kept in systems under FITACABO's responsibility, with restricted access, while needed for the stated purposes. Retention needs take into account continuity of your enquiry, legal and regulatory obligations and the exercise of rights. When no longer needed, data must be deleted or anonymised, subject to legally permitted retention.

Deletion requests must also take backups and their retention cycle into account. Any limits on deletion and reasons for retention will be explained to you. Deleting a conversation on your device is not a request to delete records held by FITACABO.

8. Data Security

We adopt technical and organisational safeguards, including access controls, protected communications and backups. Access must be limited to people and services needed for support and operation. No system guarantees absolute security; personal data incidents are handled in accordance with applicable law.

9. Your Rights

Subject to the LGPD's terms and limits, you may request confirmation and access; correction; anonymisation, blocking or deletion of unnecessary, excessive or unlawfully processed data; portability subject to regulation; information about sharing; and review of decisions based solely on automated processing that affect your interests. You may also withdraw consent, request deletion of data processed on that basis subject to legal retention exceptions, object in legally specified circumstances and petition Brazil's data protection authority, the ANPD.

10. Contact and Data Deletion Requests

Exercising your rights is free of charge. To request access, correction or deletion, including data received by ChatBot_FitaCabo on WhatsApp, email [email protected], addressed to our Data Protection Officer, Luis Lima.

  1. State the requested right in the subject, for example: "Data deletion — ChatBot_FitaCabo".
  2. Provide your name, the phone number used to contact us including country and area codes, or the email associated with the enquiry, and describe your request. If possible, include the approximate conversation dates.
  3. We may request only additional information needed to verify your identity and locate the records, protecting your data against third-party requests.

Once verified, we will assess your request and explain the action taken. Where deletion applies, it will cover personal records under our responsibility; records subject to a retention obligation or another lawful exception will have access limited to the purpose justifying retention. Our response will explain any exceptions.

For confirmation and access, a simplified response is immediate or a full statement is provided within 15 days, as set out in the LGPD. For other requests, our service target is up to 15 days, subject to applicable legal deadlines. This process covers FITACABO's records; for your account and data held by WhatsApp itself, use the platform's channels.
